Under WUCIOA, the board may impose special assessments without owner approval UNLESS the total of all special assessments in the same calendar year exceeds 5% of the annual operating budget.
Above the 5% threshold: 67% of all unit owners must approve (not just those attending the meeting).
The threshold is aggregate — prior special assessments in the same year count toward the 5% limit.
HOA Act (RCW 64.38.045)
Under the HOA Act, the board has authority to impose emergency special assessments (health, safety, property preservation) without a member vote. For non-emergency large assessments, the declaration and bylaws govern whether owner approval is required.
Calculation methodology
- Net cost to assess = Total project cost − Reserves available
- Per-unit assessment = Net cost ÷ Number of units (equal allocation)
- Monthly payment = Per-unit assessment ÷ Spread months
- 5% threshold test = (Prior special assessments + New assessment) ÷ Annual budget × 100%
Under RCW 64.90.430, a WUCIOA board may impose special assessments without owner approval UNLESS the total of all special assessments imposed in the same calendar year exceeds 5% of the annual operating budget. The 5% threshold is calculated on the aggregate of all special assessments for the year — so if the board has already imposed a special assessment earlier in the year, the new assessment's amount is added to determine whether the threshold is crossed. An assessment above the 5% threshold requires approval of at least 67% of unit owners (or a higher percentage if the declaration requires it).
