Ohio Condo Resale Certificate Calculator — 10-Day Delivery Deadline & 3-Business-Day Buyer Rescission under ORC § 5311.091

Compute the Ohio condominium resale certificate delivery deadline (request date + 10 calendar days) and buyer's rescission window (3 business days ≈ 5 calendar days) under ORC § 5311.091 (Ohio Condominium Property Act). Determines whether the certificate is on time, overdue, or not delivered; flags whether the buyer retains an unlimited pre-closing rescission right; and notes if the association fee exceeds the $400 market-rate benchmark (Ohio has no statutory cap, unlike Arizona's $400 cap). Also covers ORC § 5312.11 for planned-community resale disclosure.

Certificate timeline

Date the seller (or seller's agent) submitted the written request for the resale certificate to the association. Under ORC § 5311.091, the 10-calendar-day delivery deadline begins on this date. The request must be in writing.

Date the association actually delivered the resale certificate to the buyer or the buyer's agent. Leave blank if the certificate has not yet been delivered. If blank, the calculator will flag the certificate as "not-delivered" or "overdue" depending on whether the 10-day deadline has passed.

Scheduled date for the real estate closing. Used to determine the remaining time the buyer has to rescind before closing if the certificate was not delivered timely.

Fee of $250.00 is within the $400 market-rate benchmark. Ohio has no statutory cap under ORC § 5311.091(B); the statute requires only a "reasonable" fee. This fee appears consistent with typical Ohio market rates ($200–$400).
Buyer rights note
Certificate delivered LATE (after the 10-calendar-day statutory deadline under ORC § 5311.091). The buyer's 3-business-day (≈ 5-calendar-day) rescission window runs from the actual delivery date, ending Any time before closing (2026-06-01). However, if the late delivery constituted a material failure to timely deliver before closing, the buyer may also have an unlimited right to rescind before closing — consult Ohio counsel.

How this calculator works

This calculator applies ORC § 5311.091 (Ohio Condominium Property Act) to determine: the resale certificate delivery deadline (request date + 10 calendar days); whether the certificate was delivered on time, overdue, or not delivered; the buyer's rescission deadline (3 business days ≈ 5 calendar days after delivery); and whether the association's fee is within the $400 market-rate benchmark (Ohio has no statutory cap).

What the statute requires

ORC § 5311.091 governs the condominium resale certificate process:

  1. Seller's obligation — obtain a resale certificate from the unit owners association and provide it to the buyer before closing.
  2. 10-day delivery deadline — the association must deliver the certificate within 10 calendar days of the seller's written request.
  3. Buyer's 3-business-day rescission window — after receiving the certificate, the buyer has 3 business days (≈ 5 calendar days) to rescind the contract unconditionally.
  4. Pre-closing rescission right — if the certificate is not delivered before closing, the buyer may rescind at any time before closing.
  5. Association fee — ORC § 5311.091(B) permits a reasonable fee. No statutory cap in Ohio.

Ohio vs. other states: delivery deadline and buyer rights

| State | Delivery deadline | Buyer rescission window | Statutory fee cap | |-------|------------------|------------------------|-------------------| | Ohio (ORC § 5311.091) | 10 calendar days | 3 business days (≈ 5 calendar days) | None | | North Carolina (N.C.G.S. § 47C-3-116) | 10 business days | 5 calendar days | None | | Florida (Fla. Stat. § 718.503) | No hard statutory deadline | 3 calendar days | None | | Arizona (A.R.S. § 33-1806) | 10 business days | 5 calendar days | $400 |

Ohio's 10-calendar-day deadline is shorter in practice than North Carolina's 10-business-day window when weekends fall within the period. The Ohio 3-business-day buyer rescission window is shorter than North Carolina's 5-calendar-day window.

Fee benchmark

Ohio has no statutory fee cap. The $400 threshold used in this calculator reflects Arizona's statutory cap — used here as a market-rate benchmark to flag potentially excessive fees. Ohio associations typically charge $200–$400. Fees above $400 should be supported by documented cost justification.

The Ohio condominium resale certificate is a disclosure document required by ORC § 5311.091 that the SELLER must obtain from the unit owners association and provide to the buyer before closing. The certificate typically includes: current monthly assessments; any special assessments currently levied or planned; the association's current budget; the reserve fund balance; any violations pending against the unit; and other financial and governance information material to the buyer's decision. The SELLER's responsibility is to REQUEST the certificate from the association in writing; the ASSOCIATION's responsibility is to deliver it within 10 calendar days. The seller's agent typically handles the request as part of the transaction.
